    Florida Builders Right To Repair Current Law Summary:

    Current Law Summary: In Title XXXIII Chapter 558, the Florida Legislature establishes a requirement that homeowners who allege construction defects must first notify the construction professional responsible for the defect and allow them an opportunity to repair the defect before the homeowner canbring suit against the construction professional. The statute, which allows homeowners and associations to file claims against certain types of contractors and others, defines the type of defects that fall under the authority of the legislation and the types of housing covered in thelegislation. Florida sets strict procedures that homeowners must follow in notifying construction professionals of alleged defects. The law also establishes strict timeframes for builders to respond to homeowner claims. Once a builder has inspected the unit, the law allows the builder to offer to repair or settle by paying the owner a sum to cover the cost of repairing the defect. The homeowner has the option of accepting the offer or rejecting the offer and filing suit. Under the statute the courts must abate any homeowner legal action until the homeowner has undertaken the claims process. The law also requires contractors, subcontractors and other covered under the law to notify homeowners of the right to cure process.

    HHMR: A Retrospective — Chapter One (2001–2025)

    There comes a point in every career when you stop long enough to look back, not out of nostalgia, but out of clarity. You begin to see the arc, the accidents, the grace, and the moments when others carried more of the burden than you realized at the time. For me, that moment came recently, somewhere between the twenty-fifth year of practicing construction litigation and the rewriting of our firm’s operating agreement. I found myself asking a question I should have asked long ago: What are we building, and will it last? The truth is that we at HHMR do not build anything. Our clients do. They are the ones building Colorado, from single-family homes and multifamily developments to commercial, industrial, and infrastructure projects, navigating every constraint, hurdle, and barrier this state presents to them. They are the men and women in the arena, in Theodore Roosevelt’s sense. They pour foundations, frame walls, manage subs, balance supply chains, and take the risks inherent in the act of building anything of value. And for that work, they get sued.     Tenn. Court of Appeals Finally Clarifies Contractor Licensing Laws, Holding An “Underlicensed” Contractor Is Violation of Tennessee’s Consumer Protection Act

    September 23, 2025 —
    The title of this post says it all. No need for a catchy story about my kids or a play on words. In what had been an often debated issue in trial courts across Tennessee, the Court of Appeals recently weighed in on the issue of whether an underlicensed contractor (one who contracts beyond the monetary limitation of its license) can form the basis of a claim under the Tennessee Consumer Protection Act (“TCPA”), Tenn. Code Ann. 47-18-101 et seq. The Setup. In Zelenik v. Crowell Homebuilding LLC, (Aug. 14, 2025), the Court held that a contractor that exceeds its monetary licensing limit at the time of contracting violates the Contractor’s Licensing Act (“CLA”), Tenn. Code Ann. 62-6-101 to -139 (2019 & Supp. 2024). The Court went on to hold that the trial court properly held that a violation of the CLA, in turn, constituted a violation of the TCPA.     Trust, But Verify: Addressing Risk of Non-Payment by Owners

    December 08, 2025 —
    Receiving payment is an important piece of any for-profit business. And construction contractors are no exception. But sometimes payments do not arrive on time (or, worse yet, not at all), even when a contractor has done everything right. Ensuring that owners have the ability to pay invoices when they become due is an important upfront risk mitigation strategy that can help reduce future risks of non-payment. Although it is not possible to entirely remove this risk, there are options to help reduce it. This article will highlight some of the options to help increase payment security, both before and during the Project, to reduce the risk of non-payment for work that is otherwise properly performed. This article does not cover the entire waterfront of available options, including liens (which could be a separate topic for an entire thesis).     Older Homes for Sale in California Now Come With Wildfire Warnings

    September 30, 2025 —
    Most California homes were built long before the state required that they be constructed to withstand wildfires. Now, sellers of older homes in high-risk areas must disclose to potential buyers not only a dwelling’s susceptibility to fire but what they’ve done to address those vulnerabilities. As climate change intensifies natural disasters, states across the US have been mandating that home sellers disclose risks such as flooding. But the California disclosure is the first to zero in on a property’s ability to survive a catastrophe. That could make the state a model as wildfire and other climate threats endanger homes across the US. While three dozen states require some degree of flood-risk disclosure, only California currently mandates home sellers reveal wildfire hazards. Read the full story...
